1. Scope
These Terms and Conditions apply to all orders placed by consumers through the GERDESH online store at:

These Terms and Conditions apply exclusively to consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or independent professional activity.
2. Offer and Conclusion of Contract
The presentation of products in the online store does not constitute a legally binding offer to conclude a purchase contract, but rather an invitation to place an order.
The customer can select the desired products and place them in the shopping cart.
Before submitting the order, the customer can review and, where necessary, correct the information entered and the products selected.
By clicking the final order button, the customer submits a binding offer to purchase the goods contained in the shopping cart.
After receipt of the order, the customer receives an automatic order confirmation by email.
The purchase contract is concluded once GERDESH accepts the order. Acceptance may take place in particular by means of an express order confirmation or by dispatching the goods.
3. Contract Language and Contract Text
The contract is concluded in the languages offered in the online store.
The available contract languages are displayed in the online store.
Order data is stored in accordance with statutory retention obligations.
The customer receives the essential information relating to the order by email.

4. Products and Print-on-Demand
GERDESH offers in particular clothing items such as T-shirts, hoodies, sweatshirts, caps and other clothing products displayed in the online store.
Products may be produced using a print-on-demand process.
This means that products may only be manufactured or printed after an order has been received.
GERDESH may use external service providers for production, printing, storage, shipping and fulfilment.
Regardless of the involvement of such service providers, GERDESH remains the customer's contracting party.
The essential characteristics, materials, sizes, colours and other features of the products are set out in the respective product description.
Depending on the screen, device and individual display settings used, colours in particular may differ slightly from the actual appearance of the product.
The customer's statutory rights in the event of defective goods remain unaffected.
5. Prices
The prices displayed in the online store at the time of ordering apply.
Prices displayed to consumers include the taxes to be collected by GERDESH where applicable under the relevant law.
Shipping costs may be charged in addition to the purchase price.
For deliveries outside the European Union, import taxes, customs duties, customs clearance fees or other import-related charges may also apply unless already collected by GERDESH during checkout.
The total costs charged by GERDESH are displayed to the customer before the order is submitted.
6. Shipping Costs
Germany
Shipping within Germany costs:
€3.95
Standard shipping is free for orders of €99.95 or more.
European Union
Shipping to other Member States of the European Union costs:
€6.95
Standard shipping is free for orders of €99.95 or more.
Switzerland
Shipping to Switzerland costs:
CHF 8.50
Standard shipping is free for orders of CHF 99.95 or more.
Additional import taxes, customs clearance fees or other import-related charges may apply to deliveries to Switzerland.
Great Britain
For deliveries to England, Scotland and Wales, a minimum merchandise value of:
£150
applies.
The merchandise value after discounts is decisive.
Orders with a merchandise value below £150 are not accepted for delivery to Great Britain.
From the required minimum merchandise value of £150, standard shipping to Great Britain is free of charge.
We currently do not deliver to Northern Ireland.
The applicable shipping costs and conditions are displayed to the customer before completion of the order.
7. Delivery Area
GERDESH currently delivers in particular to:

The countries and regions actually available for delivery are displayed during checkout.
Northern Ireland is excluded from the current delivery area.
8. Delivery and Delivery Times
Delivery is made to the delivery address provided by the customer during checkout.
Shipping is generally carried out via DHL or another shipping provider indicated during checkout.
The estimated delivery times are:
Germany: 1–3 business days
European Union: 3–7 business days
Switzerland: 3–7 business days
Great Britain (England, Scotland and Wales): 3–7 business days
Business days are Monday to Friday, excluding applicable public holidays.
As our products may be produced using a print-on-demand process, a different processing or delivery time may apply to individual products.
In such a case, the delivery time stated on the respective product page or during checkout shall apply.
For deliveries to Switzerland or Great Britain, the actual delivery time may be extended due to customs clearance.
9. Deliveries to Switzerland
Deliveries to Switzerland are generally made under the following delivery term:
DAP – Delivered at Place
Import taxes, customs clearance fees and other import-related charges may apply.
These charges are generally payable by the recipient unless already collected by GERDESH during checkout.
Such import charges are not included in the shipping costs charged by GERDESH.
Import charges or customs clearance fees may therefore still apply even where shipping is free for orders of CHF 99.95 or more.
Free shipping does not mean that such import charges are covered by GERDESH.
10. Deliveries to Great Britain
Deliveries to Great Britain under these Terms and Conditions exclusively include:

Northern Ireland is excluded from the delivery area.
Shipping is generally made under the following delivery term:

Upon import, the following charges may apply in particular:

These charges are generally payable by the recipient unless already collected by GERDESH during checkout.
Free shipping does not mean that any applicable import taxes, customs duties or customs clearance fees are covered by GERDESH.
These charges may be collected by the shipping provider or the competent UK authorities before or upon delivery.
11. Customs Clearance
For shipments to Switzerland and Great Britain, additional documents may be required for customs clearance.
This may include an invoice or commercial invoice.
The order, shipping and invoice data required for customs clearance may be transmitted to our fulfilment and shipping providers and to the relevant transport and customs authorities.
Customs clearance may extend the actual delivery time.
12. Payment Methods
Depending on the country, order and availability, the following payment methods may in particular be offered:

The payment methods actually available are displayed to the customer before completion of the order.
Where an external payment service provider is used, its contractual and privacy terms may also apply.
13. Due Date and Payment
The purchase price is due upon conclusion of the purchase contract unless otherwise provided for the selected payment method.
Payment processing is governed by the payment method selected by the customer and the conditions displayed during checkout.
14. Retention of Title
The delivered goods remain the property of GERDESH until payment has been made in full.
15. Cancellation and Return Rights
Consumers are entitled to the cancellation and return rights provided by the applicable mandatory consumer protection law.
Consumers within the European Union are in particular entitled to the statutory cancellation rights applicable to distance contracts.
Consumers in Great Britain are entitled to the mandatory consumer rights applicable there.
For customers with a delivery address in Switzerland, GERDESH voluntarily grants a 14-day contractual right of return in accordance with our separate Cancellation and Returns Policy.
In the case of a standard cancellation or voluntary return, the customer bears the direct costs of returning the goods, insofar as permitted by law.

16. Returns
For easier return processing, customers may use the returns portal provided by GERDESH:

Use of the returns portal is voluntary.
Alternatively, the customer may send the goods with sufficient postage to the return address stated in the Cancellation and Returns Policy.
In the case of a standard cancellation or voluntary return, the customer bears the direct costs of returning the goods, insofar as permitted by law.
17. Complaints and Defective Goods
For damaged, defective or incorrectly delivered items, please contact:
Where possible, please provide your order number and describe the relevant defect.
Photographs of the affected item may help us process the matter.
However, the customer's statutory rights are not conditional upon photographs being provided.
The provision under which the customer bears the return shipping costs in the case of a standard cancellation does not automatically apply to defective, damaged or incorrectly delivered goods.
Where GERDESH is required to bear the necessary return shipping costs due to a defect or incorrect delivery, these costs will not be charged to the customer.
18. Statutory Warranty Rights
The statutory provisions regarding liability for defects apply.
If the delivered goods are defective, the customer is entitled to the statutory rights.
In particular, where the statutory requirements are met, the customer may demand subsequent performance and may, where applicable, exercise further rights such as a reduction in price, withdrawal from the contract or damages.
19. Liability
GERDESH is liable in accordance with the statutory provisions.
The customer's statutory claims and rights are not restricted by these Terms and Conditions.
20. Applicable Law
The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods.
For consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection granted by mandatory provisions of the country in which the consumer has their habitual residence.
21. Consumer Dispute Resolution
GERDESH is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
22. Final Provisions
Should individual provisions of these Terms and Conditions be or become wholly or partially invalid, the statutory provisions shall apply instead.
The validity of the remaining provisions shall remain unaffected.
